KnownCircle privacy policy

Your privacy is important to Pramati Technologies, the owner and operator of and related services ("we", "us" or "our"). This privacy policy provides details about how your personal information is collected and used by us. Personal information is any information that identifies you or would enable someone to contact you, such as your name, email address, phone number and other non-public information associated with your individual identity. This privacy policy explains our commitment to protecting the privacy of personal information about users of KnownCircle websites, software, products and services (collectively, the "Service"). We reserve the right to change this Policy from time to time and will notify you of any changes via email or on our website. Capitalized terms not otherwise defined in this Policy have the meanings ascribed to them in our Terms of Use.

Information Collected

1We collect personal information when you register to use the Service. Personal information may include your name, username, your password (we only store an encrypted version of this; not the actual password), one or more email addresses and other contact information. We collect information when you claim, create or modify a KnownCircle profile. A complete KnownCircle profile that includes details about your professional background and experience can help you get found by other users and can help other users add you to their KnownCircle and create and share referrals and endorsements on your behalf.

2You can change your KnownCircle information at any time by editing your profile, deleting content that you have posted, or by closing your account.

3If you use the Service from outside the United States, you consent to the transfer of your personal information to our systems in the United States and wherever we, our affiliates and service providers operate.

See also "Use of Cookies and Similar Technologies" below.

Our Use of Your Information

4Information contained in your KnownCircle profile and other information about you can be seen by other users of the Service and may be used by us in a variety of ways. By using the Service you agree to permit such information to be viewed and used as described in this Policy and our Terms of Use.

5We will communicate with you using KnownCircle interfaces, email, and other ways available to us. We may send you messages relating to the availability of the Service, security, or other Service-related issues, features and offerings. You may elect not to receive commercial marketing messages from us about the Service. We may assign you a user ID and password to use the Service. We assume no responsibility for preventing third parties (other than our own employees) from using your login credentials, whether with or without your permission.

6We do not sell or rent user personal information to third parties or otherwise share your personal information with third party marketers. Also, under our Terms of Use, KnownCircle users are not permitted to copy or use the user information they obtain from the Service to market third party products or services (for example users may not create and sell user lists for anyone else to use for marketing or lead generation purposes).

7We use the personal information we collect to enable your access to and use of the Service, to personalize the Service for you, or to supply the services you ask for. We use information and content that you and other users provide to us to conduct research and development for the improvement of our Service, including to provide you and other users with a better, more intuitive experience and drive adoption and engagement on our Service and to help users share information and referrals about their KnownCircle connections. For example, when you sign in to your account, we may display the names and photos of users who have recently been added to your KnownCircle(s).

8We offer a public profile feature that allows you to publish portions of your KnownCircle profile to the public Internet. This public profile will be indexed and displayed through public search engines when someone searches for your name. We do not exercise any control over the way third party search engines find or use the public portions of your KnownCircle profile. If you are a Business User, as a condition to using the Service, you further grant Pramati Technologies and its affiliates a non-exclusive worldwide royalty-free license and right to use, reproduce, display, distribute and transmit the content of your KnownCircle profile, the name of your business, its logo and any trademarks and any photographs, graphics, artwork, text and other content provided or specified by you, including the likeness of any person contained in such content, in any media and any manner in our discretion in connection with the operation, performance, delivery, promotion, development or sale of the Services.

9Once you have created a KnownCircle or been added to any other user's KnownCircle, your name, contact information and profile image (your photograph) will be accessible to all other users viewing that KnownCircle. We also may display your name and profile image to any users who are either connected to other users in your KnownCircle(s) or who are viewing the KnownCircle profile of any users in your KnownCircle.

10We also display your name and may display other personal information associated with your account or profile in connection with various communications and messages you initiate and send through the Service (these communications may include, for example, inviting another user to join your KnownCircle, requesting a referral or endorsement, requesting a quote or proposal from a service provider, posting a comment to a KnownCircle profile, or replying to any of the foregoing).

11If you elect to share KnownCircle content, profiles, referrals, endorsements or other information from the Service with your friends, you may be prompted to enter an email address and password, a social networking account ID and password, or other credentials in order to use the Service. We do not market, sell or rent your email address or social networking account ID to third party marketers.

12If you share a referral or endorsement about a KnownCircle user using email, a one-time email will then be sent to your friend(s) inviting them to visit the Service. We store your friends' addresses only for the purpose of allowing you to keep track of the friends with whom you share KnownCircle content. We do not share your friends' email addresses with any third party. You may also access your email address book using the Service by selecting your address book service provider and entering your user ID and password. Only those friends that you select will be sent an email. We do not store your email account password or your contact lists.

13To refer friends to a user in your KnownCircle using a social network, blog or bookmarking site, you will be asked to enter your account ID and password so that the content you want to share can be posted by you. If you choose a social media service such as Facebook to share content using the Service, we may receive personal information of yours that may include, for example, your social media profile (e.g. your Facebook® profile name, and its associated email address, but never your password). The information posted at your social media account such as wall posts, likes or items you follow will be accessible to us only if and to the extent you have (1) opted to make this information publicly available or (2) authorized the use of private information through a permission grant or other means provided by that social media service, in which case we may use such information for the sole purpose of providing our Service to you and other users.

14We collect statistical data regarding the use of the Service which we use in our business. Such data may include non-personal information such as your computer IP address which we use for statistical demographic research, such as to determine the number of KnownCircle users or referrals made within a particular location. Such data also may include, for example, how many referrals or requests for quote are sent by you, which social networking or other channels are used, how many people receive and view a referral, how many people click on the referral or view a KnownCircle profile. We may provide users that maintain KnownCircle business profiles with reports about the use of our Service including such statistical data. Our reports do not include personal information that can be used to identify or contact you, unless you have expressly agreed to share such information by joining a user's KnownCircle or otherwise opting-in using the Service.

15California Civil Code Section 1798.83, known as the “Shine The Light” law, permits our customers who are California residents to request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any personal information with third parties for their direct marketing purposes.

Use of Your Information by Other Users and Third Parties

16We are not responsible for the use of your personal information by other users once they gain access to your information through the Service. The use of your personal information by other users may be governed by rules, laws, regulations and/or privacy policies applicable to such other users and their businesses.

17If you post comments or other content on other user profile pages or any other parts of the Service available to other users, you should be aware that any personal information you submit there can be read, collected, or used by other users and could be used to send you unsolicited messages.

18The Service also may contain links to other websites or services maintained by our users or third parties. We make no representation or warranties and are not responsible for the operation of such other sites or services or the privacy policies or practices of any third party.

Use of Cookies and Similar Technologies

19Like most web-based services, we may automatically collect information that your browser sends whenever you visit a website. This information includes, without limitation, Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data ("Usage Data"). We use Usage Data to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole. When you are logged in to the Service, your Usage Data may be associated by us with your account.

20Like many websites, we may also use "cookies" and similar technologies, including mobile application identifiers, to collect information and manage Service features. A cookie is a small data file that we transfer to your computer or device for Service management and record-keeping purposes. We may use "persistent cookies" to save your registration ID and login password for future logins to the Service; and we may use "session ID cookies" to enable certain features of the Service, to better understand how you interact with the Service and to monitor Service usage. When you use the Service, cookies may enable us to associate your Usage Data with your account, even if you have not logged in. We may use cookies to help us recognize you across different parts of the Service, learn about your interests both on and off our Service, improve your experience, increase security, measure use and effectiveness of our Service, and/or serve advertising.

21You can control cookies through your browser settings and other tools. By visiting our Service, you consent to the placement of cookies and beacons in your browser and HTML-based emails in accordance with this Privacy Policy. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Service or all functionality of our services.

22We may employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that helps us better manage content on our site by informing us what content is effective and prompts user attention. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of users. In contrast to cookies, which are stored on a user’s computer, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. We tie the information gathered by clear gifs to your account information.

23If you access the Service from a mobile device, we also receive your mobile device identifier provided by your mobile device operating system, your mobile operating system and the name of your ISP or your mobile carrier. We may also receive location data passed to us from third-party services or GPS-enabled devices that you have set up, which we use to show you local information (for example, KnownCircle profiles near you) on our mobile applications and for fraud prevention and security purposes. Most mobile devices allow you to prevent real time location data being sent to us, and we will honor your settings.

24Your use of a "Do Not Track" option in your browser will not affect our data collection practices or use of such third party services.

25The use of cookies, beacons and mobile identifiers by third party services you may access through the Service is not covered by our Privacy Policy. We do not have access or control over these third party services.

26Our user list and Usage Data we collect are assets and trade secrets of Pramati Technologies and may be transferred with the company's assets in connection with any merger, acquisition or change of control of the business of the company. We may also disclose your personal information to a third party as part of a sale or other transfer of the assets comprising the Service. Any third party to which we transfer or sell our company, control or assets will have the right to continue to use the personal and other information that you provide to us in the manner set out in this Privacy Policy.

Required Disclosures

27Except as stated in this privacy policy, we will not disclose your personal information to third parties, except to the extent we have your separate consent or we have a good faith belief that disclosure is permitted by law or reasonably necessary in order to: (a) comply with a legal requirement or process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (b) enforce this Privacy Policy or our Terms of Use; (c) respond to claims of a violation of the rights of third parties; (d) respond to your Service inquiries; or (e) protect the rights, property, or safety of our company, Service, users, or the public.

Updating Personal Information

28If your personal information changes, you may correct, update, amend, delete/remove information through the Service or by emailing our Customer Support team at We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Public Posts and Testimonials

29We have no obligation to keep the information you post to the public portions of the Service private or protected in any way. All such content may be published by us in any media in our discretion. Pramati Technologies, its affiliates, officers, directors, employees and agents assume no liability or responsibility for your use of the public portions of the Service to post comments or other information, or for any person's use of any information you post there.

30We may display personal testimonials of satisfied users on our site in addition to other comments about our Service. With your consent we may post your testimonial along with your name.

31The security of your personal information is important to us. We have implemented security safeguards designed to protect the personal information that you provide in accordance with industry standards. Access to your data on our Service is password-protected. To protect data you store on our servers, we also regularly monitor our system for possible vulnerabilities and attacks. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that your communications with other users on the Service are not encrypted, and we strongly advise you not to communicate any confidential information through these means. Please help keep your account safe by using a strong password.

32Our Service is designed to be used by people 18 years of age or older. The Children's Online Privacy Protection Act ("COPPA") protects the online privacy of children under 13 years of age. We will not knowingly collect or maintain personal information from anyone under the age of 13, unless or except as permitted by law. Any person who provides personal information through the Service represents to us that he or she is 13 years of age or older. If we learn that personal information has been collected from a user under 13 years of age, then we will take the appropriate steps to cause this information to be deleted.

33We may change this Privacy Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide notice to you through the Service or by some other means, such as email. Please review the changes carefully. If you agree to the changes, simply continue to use our Services.
